TERMS AND CONDITIONS OF USE OF THE "LALIGA FANTASY" GAME
1.- OWNERSHIP AND PURPOSE
These terms and conditions govern the terms of use (hereinafter, the "Terms") of the LALIGA Fantasy game in its app and web versions (hereinafter, the "Game") by its users. The Game is the exclusive property of LaLiga Group International, S.L., with Tax ID No. B05421805 and registered office in Madrid, C/ Torrelaguna 60, 28043 (hereinafter, "LALIGA").
LALIGA is a company duly incorporated under Spanish law, majority-owned by the National Professional Football League. For more information about LALIGA, please see the Legal Notice.
LALIGA provides the Game for those users who wish to play it, consisting of a football manager game where users can create virtual leagues to play with other users, the aim being to score as many points as possible . The score is obtained from the sum of the points obtained by each player lined up on each match day of the First Division National League Championship. Points are awarded to each player according to a series of criteria, including goals, yellow and red cards, among others. The seasons of the National First Division League during which the matches are played generally run fromChampionship 1 July to 30 July of the following year, approximately.

This Game has been developed for use on mobile devices with iOS, Android OS, Windows Phone or other similar operating systems, and LALIGA may carry out periodic updates to it.
2.- USER
By registering and creating an account (hereinafter, the "Account") in order to use the Game, you automatically become a user (hereinafter, "User") and agree to accept and comply with the Terms and Conditions. In accordance with the above, the User undertakes to read these Terms and Conditions, as well as any others that regulate the use and enjoyment of the Game or its environment, before using or enjoying the Game. You may save these Terms and Conditions or print them for future reference. LALIGA will also save the text of the entire contract and make it available to you upon request.
The User is aware and voluntarily and expressly accepts that the use of the Game is in all cases under their sole and exclusive responsibility.
The Game is provided for private and non-commercial use. You may not use the Game for commercial purposes or associate yourself with the Game for advertising purposes without our express written consent.
Minimum age.
In order to register and use the Game, you must be over sixteen (16) years of age or have the authorisation of your parents and/or legal guardians. Therefore, by accepting these Terms and Conditions, you guarantee that you are over that age or, if not, that you have the aforementioned parental authorisation to register for the Game, taking full responsibility for that statement.
In order to access the paid services offered in the Game, the minimum age for contracting such services is eighteen (18) years of age or the age of majority in your place of residence.
LALIGA may contact the User at any time to request proof of their actual age by providing a photocopy of their National Identity Document or equivalent document. If the User fails to provide the aforementioned documentation, LALIGA reserves the right to block the User's use of the Game.
3.- GENERAL TERMS AND CONDITIONS OF USE
3.1.- Registration: username and password
In order to use and enjoy the Game, the User must register by providing the information required to validate the registration. To register, the instructions included in the forms provided in the Registration option must be followed.
All information provided by the User through the forms presented to them to access the Game's features for the above purposes or any other purposes must be truthful, and specifically, the User must be the owner of the email address they provide, where applicable. To this end, the User guarantees the authenticity of all data provided and will keep the information provided fully up to date so that it reflects the User's actual situation at all times. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damage caused to LALIGA or third parties by the information provided.
When the User creates a User Account, they are assigned the username and password (hereinafter, "Identifiers") that they specify, which will allow them to access their private Account. Identifiers are personal and confidential. They can only be changed at the request of the User or on the initiative of LALIGA. For security purposes, the User undertakes to ensure that the password chosen to register for the Game is unique, i.e. that it is not used for any other application, email account or similar. The Identifiers assigned shall be personal and non-transferable, and may not be transferred, even temporarily, to third parties. In this regard, the User undertakes to make diligent use of and keep secret their assigned Identifiers, where applicable, to access the Game and/or the Content. In the event that the User knows or suspects the loss, theft or use of their password or confidential Identifiers by third parties, they must notify LALIGA of this circumstance as soon as possible.
The User shall be liable for any expenses and damages caused by access to and use of the Game and/or the Content by any third party who uses the User's Identifiers for this purpose due to the User's negligent use or wilful loss of said Identifiers.
Single Sign-On service (LALIGA Single Sign-On):
LALIGA has implemented a single sign-on registration and login system (LALIGA Single Sign-On) that allows the User to access an environment created by LALIGA (LALIGA Ecosystem) and made up of several applications and websites, both from LALIGA and from affiliated football clubs with which LALIGA has collaboration agreements, with the aim of allowing the User to enjoy a series of advantages. Each user receives a unique identifier so that any selection or modification of preferences or request for deletion made in one of the applications or websites that form part of the ecosystem will affect the rest of the LALIGA Ecosystem environment and the entities that comprise it.
Through LALIGA's Single Sign-On, a unique "fan profile" is created across all channels (assets) connected to the LALIGA Ecosystem, which is shared by and all the entities responsible for these assets (LALIGA applications and websites, affiliated club applications and websites, etc.).

3.2.- Other associated accounts
For certain aspects of the Game, you may be able to set up additional accounts that are dependent on your account ("associated account(s)"). The User agrees to be bound by these Terms and Conditions for any associated accounts (including those of minors) that they currently have or may create in the future, and that the User is responsible for all activity carried out with their account and any associated accounts. The User agrees that LALIGA may take action against their account in response to the activity of any of their associated accounts, including (i) limiting who can use their Game account or any associated accounts; (ii) limiting the number of devices from which they can access the Game; (iii) and/or deleting their Account or any associated accounts.
If you allow or authorise a minor to use an associated account:
- The User declares that they are the parent or legal guardian of the minor;
- The User agrees to supervise the use made by minors whom the User allows or authorises to use the Game. The Game is not intended for use by children under the age of sixteen (16) without adult supervision;
- If you use an associated account, you acknowledge that the Account holder has full control over your associated account. This control includes the right to: (i) terminate your use and enjoyment of the Game; (ii) close or alter your associated account at any time; (iii) access or modify the Parental Controls for your associated account; and (iv) receive notifications from LALIGA. In some cases, this control also includes the ability to request and receive information about the use of the device and the Game services in relation to your associated account. Collect profile, usage and activity data related to your associated account and send it to the Game services account holder.
The Game includes paid subscriptions that allow the User to enjoy LALIGA Fantasy without advertising. For a monthly fee, the User may use the Game without having to view advertisements.
Users who are of legal age and reside in Spain may subscribe. To do so, they must have a credit or debit card with a Spanish bank or linked to their iTunes account.
Payment will be made through the account associated with the User's device, either App Store or Google Play. A credit card is requiredor debit associated with the account .
The subscription fee for the ad-free Game will be charged once a month, around the date on which the User subscribed. If the billing date is scheduled for a day that does not exist in all months (e.g. the 31st), the charge will be made on the last day of that month.
The subscription will be automatically renewed for the same duration as the initial term, unless the subscription is cancelled by the User in accordance with the provisions of the section "Cancellation by the User".
- Right of withdrawal: the User has the right to terminate their Subscription contract with us without justification within fourteen (14) days of purchase provided that they have not started accessing the Game.
To request a refund for a subscription, it will depend on:
· If the User made a subscription request from an iOS device, they must access the URL: https://support.apple.com/es-es/HT204084 and request a refund. You must first confirm whether the purchased product is eligible for a refund according to Apple's refund policies. · If the User made a subscription request from an Android device and wishes to cancel, they can request a refund by accessing their account settings. - Cancellations by the user: If the User does not want their monthly subscription to renew automatically, they must cancel the subscription at least 24 hours before the end of the current period. The renewal will be charged on the same day the subscription began.
The User may cancel their subscription and continue enjoying LALIGA Fantasy with advertisements by accessing their account settings on their device, accessing the purchased subscription and requesting cancellation.
3.4.- Premium Access with Tokens
The Game may include the option to purchase payment tokens that allow the User to access new features or improvements within a league during the applicable season. Tokens are a one-time payment and not a subscription. The price of tokens is set at the time of purchase and is not subject to change for that specific purchase.
Tokens are personal and can only be redeemed by the administrator of the league for which they are used. Tokens are non-transferable, non-convertible to money or credit usable outside the Game, and only redeemable within the Game ecosystem through the enabled channels.
Each Premium token is valid exclusively for the championship season in which the purchase is made. The validity of the token extends until the official end date of that season. The token will automatically expire at the end of the applicable season if it has not been redeemed/activated before that date. After expiry, the token cannot be redeemed or used in subsequent seasons and will not generate any right to a refund.
LALIGA reserves the right to modify the price of tokens for future seasons due to changes in market conditions, significant increases in the costs of acquisition or provision of the service, or in the event of changes in VAT or any other similar tax. Price changes will be reflected directly in the Game and will be effective for purchases made after the date of the price change. No prior notification to users will be required for changes in the price of tokens, as these do not involve recurring payments or subscriptions.
- Right of withdrawal: the User has the right to request a refund for a token Premium without justification within fourteen (14) days of purchase, provided that not it has been redeemed.

3.5 .- Misuse of the Game
The User undertakes to make appropriate use of the Game and the Content that can be accessed through it, and not to use them to engage in activities that are illegal or contrary to good faith and the legal system; disseminate Content or propaganda of a racist, xenophobic, pornographic nature, or that advocates terrorism or violates human rights; cause damage to the physical and computer systems of LALIGA or its suppliers, introduce or spread computer viruses or any other physical or computer systems that are likely to cause the aforementioned damage.
3.6 .- Provision of Content by the User: licence grant and warranties
In the event that the functionality of the Game allows the User to make Content available (hereinafter, "Content" shall be understood to mean the following: opinions, observations, comments, graphic material, photographs, links, questions, suggestions, information, videos, audio and other materials that the User sends to the Game or communicates using the Game), the User is free to make such Content available to , providing LALIGA with any information it may require in relation to the origin and ownership of the Content and the procedure by which the User obtained it. This information must be accurate and verifiable if LALIGA so requires.
LALIGA shall decide freely and without any obligation on its part which Content should be made available to the public through the Game. In the event that LALIGA opens up the possibility of accessing Content made available through the Game by Users, the latter declare that they are aware and accept that, once made available to other Users of the Game, the Content will be available to third parties worldwide, and therefore expressly exempt LALIGA from any liability for any claims in this regard.
3.6 .1.- Rights granted by the User under licence
All Content communicated by the User through the Game may not be considered confidential and/or private. The User acknowledges and accepts that LALIGA only acts as a passive channel for the distribution, where applicable, of User-generated Content, and assumes no responsibility or liability to the User or any third party with respect to the Content or the accuracy of the Content generated.
In this regard, the User expressly acknowledges that by making different Content available to LALIGA in the Game, this Content has been obtained, produced and/or acquired directly by the User themselves, such that they hold all necessary rights to it, with sufficient legitimacy to transfer them to LALIGA under the terms and conditions set out in this document. Thus, by virtue of this document and through the aforementioned act of making it available, the User shall be granting:
(I).- In favour of LALIGA, a worldwide, non-exclusive, free, sublicensable and transferable licence for any use of the Content, including its commercial exploitation, as well as for advertising and non-commercial uses, to reproduce, distribute, publicly communicate and transform the Content, to create derivative works from the Content, all in connection with the provision of the Game's services and the operation of the Game and LALIGA's activity, including, without limitation, for the purposes of promoting and redistributing all or part of the Game (and its derivative works) in any format and through any communication channel;
(II).- In favour of each user of the Game, a worldwide, non-exclusive and royalty-free licence to access the Content through the Game, and to use, reproduce, distribute, create derivative works from, display and execute such Content to the extent permitted by the functionality of the Game and in accordance with these Terms and Conditions.
The above licences granted by the User with respect to the Content shall be cancelled when the User deletes or removes the User Content from the Game.
The above licences granted by the User with respect to User Content are perpetual and irrevocable, without prejudice to their property rights, which shall remain with the User at all times, in accordance with the provisions of the previous section.
3.6 .2.- Guarantees
If a User makes Content available to other Users of the Game, if the Game's functionalities so permit, this implies that said User guarantees that:
a) The Content does not constitute or contain defamation or slander against any person, company or association, does not infringe the regulations on the protection of honour, personal privacy and personal image in force in Spain at the time of submitting the Content, and that nothing in it infringes intellectual property rights, industrial property rights or any other rights belonging to third parties.
b) In order to make this transfer of rights, they have the authorisation of the persons appearing in the Content.
c) The User declares and guarantees that they are the owner (and will continue to be so while using the Game services) of all licences and all rights, consents and permissions necessary to allow LALIGA to use their Content for the purposes of providing the Game service and for any other purpose in accordance with the form contemplated in the Game and in these Terms and Conditions.
d) The User undertakes not to publish or upload any Content that contains material whose possession is illegal for the User in their country of residence, or whose use or possession is illegal for LALIGA in relation to the provision of the Game services.
e) The User undertakes that the Content provided by the User to the Game shall not contain material subject to third-party intellectual property rights or material subject to other third-party industrial property rights (including exclusivity or publicity rights), unless the legal owner of such rights has granted a formal licence or authorisation, or is otherwise legally authorised, to publish the material in question and to grant LALIGA the licence indicated above.
f) Upon becoming aware of any breach of these Terms and Conditions, LALIGA reserves the right (although it shall not be obliged) to decide whether the Content complies with the Content requirements stipulated in these Terms and Conditions, and may remove such Content and/or cancel any User's access to upload Content that infringes these Terms and Conditions at any time, without prior notice and at its sole discretion.
LALIGA will pursue any breach of the above Terms and Conditions as well as any misuse of the Content presented in the Game, exercising all civil and criminal actions that may correspond to them by law. If the User views Content in our Game that they consider to be illegal, harmful or offensive, they are kindly requested to report it to LALIGA via the following email address: support@laligafantasy.zendesk.com.
3.7 .- Other Content
With the exception of Content provided to the Game by the User, all other Content in the Game shall be the property of LALIGA, or shall be licensed to it, and shall be subject to copyright, trademark rights and other intellectual and industrial property rights of LALIGA's licensor(s). All trademarks and service marks of other third parties present in the Content not uploaded or published by the User shall be trademarks and service marks of their respective owners.
Such Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or exploited for any purpose without the prior written consent of LALIGA, or LALIGA's licensors, if applicable. LALIGA and its licensors reserve all rights not expressly granted with respect to their Content.
3.8 .- Advertising
The User acknowledges and accepts that advertising may appear in the Game and that, therefore, they may access advertising from LALIGA and/or third-party companies or professionals that contract with LALIGA.
Likewise, it is possible that the app store through which the User downloads the Game may allow the User to pay a fee to prevent advertising from appearing in the Game. In this regard, LALIGA disclaims any responsibility for the relationship between the User and the owner of the app store to prevent advertising from appearing in the Game. If the User wishes to exercise their right to terminate the contract entered into with the app store, they must comply with the withdrawal policy of the app store in question.
3.9 .- Disclaimer
LALIGA shall not be liable for any damages caused by the misuse of the Game by Users. Any act that contravenes applicable legislation shall be the responsibility of the User who performs it.
In this regard, and within the limits established by applicable regulations, LALIGA shall not be liable for any infringements committed by any User of the Game that may affect any other User of the Game or third parties, including those relating to intellectual property rights, industrial property rights, confidential information and/or any other similar rights. Likewise, they shall not be liable for infringements by a User of the personal privacy, honour and/or image of another User or a third party, which shall be the sole responsibility of the offender, whether these are statements made in forums, user opinions or audiovisual material provided by the user, in the event that such functionalities exist.
The User accepts their responsibility and the consequences arising from the violation of these rules, undertaking to hold LALIGA harmless from any claim for this reason.
Any liability attributed to LALIGA for any damage or harm arising from any of the above in judicial or extrajudicial proceedings, by a court, tribunal or competent public administrative body, shall be recovered from the User, including all amounts that LALIGA has had to pay and bear, including consequential damages and loss of profits, and any costs or charges it may have incurred, including taxes, fees, lawyers' fees, solicitors' fees, arbitration fees and any other fees.
4.- OTHER TERMS OF USE
The Game is available to the User through LALIGA's own media and services, as well as through various third-party portals, services, platforms, environments and tools.
These Conditions supplement any other conditions or general terms that may regulate the website from which the Game can be accessed, or any service, procedure, mechanism, platform, environment or medium that may be necessary for the use of the Game, prevailing over such texts in the event of any discrepancy.
Some Game services accessible to Users may be subject to specific conditions, regulations and instructions which, where applicable, replace, supplement and/or modify these Terms and Conditions and which shall be deemed to have been accepted by the User if the corresponding service is provided.
It is not permitted to carry out techniques or actions within the Game that are fraudulent or contrary to the proper use and normal functioning of the Game in any of its game formats (LALIGA Fantasy or Sponsored Leagues), for example:
- Any mechanism that is likely to be unusual and that leads to the accumulation of all the money or the best players in a single user.
- Any option involving off-market sales and unrealistic prices.
5.- LINKS TO THIRD PARTIES
For the convenience of the User and in order to improve the use of the Game, links to websites owned and controlled by third parties may be provided from time to time.
These links take you outside the service and are beyond the control of LALIGA. The sites to which the User may link have their own separate terms and conditions and privacy policies. LALIGA is not responsible and cannot be held liable for the content or activities of these sites. Therefore, your visit or access to these sites is entirely at your own risk.
In particular, LALIGA shall not be liable for the technical availability, the Content, or any damage that the User may suffer as a result of consulting or using the Content offered through a website that the User accesses from the Game. In particular, the User may find surveys or forms on these associated pages requesting personal or other information for various reasons or purposes. The User is free to accept or decline these offers, but if they do so, they will establish a direct relationship with the third party in question, and LALIGA may have no relationship with it other than the establishment of a link or access from the LALIGA Game. In this case, this website will be governed by its own data protection rules and general conditions (which will normally be different from those of the Game), which the User must consult and, where appropriate, accept.
6.- SPONSORED LEAGUES
The so-called "" Sponsored Leaguesare virtual leagues that may be managed either by LALIGA or by LALIGA's commercial partners ("Partners"), consequently, LALIGA shall not be liable for the Content or for any damage that the User may suffer as a result of consulting or using the Content offered through a League Sponsored by a Partner that the User accesses from the Game.
If a User decides to register to participate in one of the Sponsored Leagues offered by LALIGA in its Game, they will be asked to complete specific additional forms in each case, filling in at least those fields marked as mandatory for the purposes and objectives of that particular Sponsored League. Once the form has been completed correctly, a confirmation email will be sent to the address provided by the User. By registering for the Sponsored League, the User expressly authorises LALIGA to transfer their personal data to the Partner responsible for said Sponsored League, whose name will be indicated in the legal terms and conditions accepted by the User, for the purposes of the Partner being able to provide the service requested by the User, as well as for any other purposes indicated in the aforementioned legal terms and conditions.
It shall be the User's responsibility to ensure that all information provided during participation in these Sponsored Leagues is accurate and up to date.
The mandatory data to be provided is specified on the form itself, and refusal to provide it will mean that you will not be able to register as a participant in the Sponsored Leagues.
6.1.- Mahou Sponsored League
The League Sponsored by Mahou is a league that is not managed by LALIGA but by MAHOU, S.A. Consequently, LALIGA shall not be liable for the Content or for any damage that the User may suffer as a result of consulting or using the Content offered through the Sponsored League that the User accesses from the Game.
6.2.- Dazn Sponsored League
The Dazn Sponsored League is a league that is not managed by LALIGA but by DAZN SPAIN, S.L. Therefore, LALIGA shall not be liable for the Content or for any damages that the User may suffer as a result of consulting or using the Content offered through the Sponsored League that the User accesses from the Game.
6.3.- Cadena SER Sponsored League
The Cadena SER Sponsored League is a league that is not managed by LALIGA but by SOCIEDAD ESPAÑOLA DE RADIODIFUSIÓN, S.L.U . Consequently, LALIGA shall not be liable for the Content or for any damage that the User may suffer as a result of consulting or using the Content offered through the Sponsored League that the User accesses from the Game.
6.3.- Contests and Competitions
Contests in which you participate within a Sponsored League or those conducted directly by LALIGA or by a Partner through specific promotions may be governed by additional terms and conditions, but the following general rules apply to all contests, unless otherwise specified in the additional terms and conditions.
Submissions and Participation
The submission of Content by the User to participate in contests is subject to all the provisions of these Terms and Conditions regarding the submission of User-generated Content. We may disqualify entries that are submitted after the deadline, have not been sent to the correct address, are incomplete or in corrupted files, have been lost, are illegible or invalid, or for which the necessary consent from parents or guardians has not been provided. Participation in competitions is limited to one entry per person and the use of agents or third parties or multiple identities is not permitted. The use of mechanisms for automatic submissions or votes and other similar programmes is prohibited; all submissions (or votes) made using such methods will be disqualified.
We reserve the right to modify, suspend, cancel or terminate a competition, as well as to extend or resume the entry period for the competition or to disqualify any participant or entry at any time and without prior notice. We will do so if we cannot guarantee that the competition will be conducted fairly or correctly for technical or legal reasons, or for other justified reasons not attributable to us, or if we suspect that any person has manipulated the entries or results, provided false information, or acted unethically. If we cancel or terminate a competition, prizes may be awarded in any manner we deem fair and appropriate in accordance with the local legislation governing the competition. We will inform participants of these circumstances and changes as soon as possible.
Requirements for participation
To participate in a competition, you must be a registered User of one of the Sponsored Leagues that runs some type of competition or contest and have an active account with up-to-date contact information. No purchase is necessary to participate in a competition, and making a purchase will not increase your chances of winning. Contests are not open to members of LALIGA and the Partner that manages the Sponsored League (or their immediate family members, i.e. first degree relatives) or any other person who is related to the contest by virtue of their profession. We reserve the right to request proof of identity or to verify the conditions of participation of potentially winning entries, as well as to deliver any prize in person to the winner.
Liability
In the event that LALIGA organises a draw and/or competition through the Game, the draw and/or competition will not be sponsored, endorsed or administered by any app store or social network, nor will it be associated in any way with them. The User is completely disassociated from the owner of the app store or social network and is aware that they are providing their information and personal data to LALIGA and not to the app store or social network.
Prizes
There will be no cash prizes or alternative prizes; however, LALIGA's Partner reserves the right to substitute a prize for another similar prize of equal or greater value. Winners may not transfer or sell their prizes. Only the number of prizes indicated for the competition will be available, and all prizes will be awarded provided that a sufficient number of valid entries have been received and the prizes are validly claimed before the date indicated in the competition; after that date, no alternative winners will be selected and any unclaimed prizes will not be awarded. Unless otherwise stated in the prize description prior to entry into the competition, winners are responsible for all costs and expenses associated with claiming their prize. All taxes are the sole responsibility of the winner, although we reserve the right to withhold applicable taxes and the winner agrees to complete the relevant tax forms.
By accepting a prize, the winner consents to participate, on a reasonable basis, in publicity related to the competition and grants us the unconditional right to use their name, town or city and state, province or country, image, information about the prize and statements about the competition for advertising or promotional purposes in accordance with applicable law, all without the need to obtain their authorisation or offer them additional compensation. As a condition of receiving a prize, winners (or their parents or guardians) may be required to sign and submit an affidavit stating that they meet the eligibility requirements, release us from liability, and grant us the necessary rights to carry out the publicity.

7.- INTELLECTUAL AND INDUSTRIAL PROPERTY
All industrial and intellectual property rights of the elements that make up the Game as well as its Contents (videos, images, designs, texts, photographs, software, etc.) and the Content to which it gives access belong exclusively to LALIGA or have been duly transferred or licensed to LALIGA and may not be reproduced, copied, pasted, linked, transmitted, distributed, publicly communicated, transformed or manipulated in any way or for any purpose, without the prior written authorisation of LALIGA.
The use of the Game and its services is authorised solely and exclusively for the User's personal and private use, and its use for commercial purposes, distribution, modification, alteration or decompilation is therefore strictly prohibited.
Any use or modification of the material or Content for any purpose other than that authorised in these Terms and Conditions, such as, for example, use for commercial purposes or in public events, shall be considered a violation of Intellectual and Industrial Property laws and any other national and/or international regulations applicable to the protection of copyright and any other legal rights that may be infringed.
8.- PRIVACY POLICY
LALIGA acts in full compliance with the obligations and guarantees established by current regulations on Data Protection:
Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights.
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

9.- DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
a) LALIGA will operate the Game with a reasonable degree of professionalism and diligence. With regard to content accessible upon payment, we remind you of the existence of a legal guarantee of conformity applicable to digital services as established in Article 114 et seq. of Royal Legislative Decree 1/2007 of 16 November, the General Law for the Protection of Consumers and Users ("legal guarantee"). This legal guarantee of conformity applies to subscriptions made in Spain. Please consult the regulations for more information on the terms and conditions of the legal guarantee.
b) LALIGA makes no other promises or guarantees regarding the Game and, within the limits established in the applicable regulations, does not guarantee in particular that:
- the User's use of the Game will be free from interruptions or errors. However, LALIGA will make its best efforts to correct any errors detected by LALIGA or reported by Users. The User accepts that LALIGA may occasionally interrupt the operation of the Game for indefinite periods of time or close the Game at any time for technical or operational reasons, in which case it will notify the User of this circumstance as far as possible;
- the Game shall be free from loss, corruption, attacks, viruses, interference, acts of computer piracy or other security intrusions, which shall constitute circumstances of force majeure, with LALIGA declining any liability in relation to such circumstances. Some Content can only be downloaded once; thereafter, it cannot be replaced regardless of the cause of the loss. The User shall be responsible for making backup copies on their own system, including copies of any Content purchased through the Game.
b) For clarification purposes, LALIGA shall not be liable, the User being solely responsible for their contracting, knowledge and control, for any other costs that may be incurred for the correct reception of the Game (other than the specific consideration that LALIGA may establish for the specific download of the Game or all or any of the services and Content offered through it).
c) Except as provided in section (e) below, or in the event that the User exercises their legal right to receive a refund or compensation, neither LALIGA nor its directors, officers, employees, affiliates, agents, contractors or licensors shall be liable in any way for any loss or damage caused by LALIGA, its employees or agents when:
(i) the legal duty of care owed to the User has not been breached by LALIGA or any of its employees or agents;
(ii) it was not a reasonably foreseeable result of such breach;
(iii) any increase in the loss or damage is due to the User's breach of any provision of these Terms and Conditions;
(iv) it is a consequence of LALIGA's decision to remove or refuse to process any information or Content, issue a warning, suspend or cancel the User's access to the Game, or take any other action during the investigation of a possible breach or as a result of LALIGA's determination that a breach of these Terms and Conditions has occurred; or
(v) involves loss of income, business or profits or loss or corruption of data related to the User's use of the Game.
d) LALIGA shall use all possible means to protect the information sent by the User to the Game, including protection against any type of fraudulent use, and LALIGA may request a password change at any time for security purposes.
e) Nothing in these Terms and Conditions shall exclude or limit LALIGA's liability for fraud, gross negligence, wilful misconduct, death or personal injury, or the User's rights under applicable mandatory consumer and user regulations. With regard to paid content in the Game, we remind you of the existence of a legal guarantee of conformity applicable to digital services as established in Article 114 et seq. of Royal Legislative Decree 1/2007 of 16 November, the General Law for the Protection of Consumers and Users ("legal guarantee"). This legal guarantee of conformity applies to purchases made in Spain. Please consult the regulations for more information on the terms and conditions of the legal guarantee.
f) If the User breaches these Terms and Conditions, they shall be liable to LALIGA, its directors, officers, employees, subsidiaries, agents, contractors and licensors for any claims arising from such breach. Likewise, the User shall be liable for any measures taken by LALIGA in the context of investigating a possible breach of these Terms and Conditions or as a result of LALIGA's determination or conclusion that a breach of these Terms and Conditions has occurred.
10.- RIGHT OF LALIGA TO MAKE CHANGES TO THE GAME.
LALIGA reserves the right to make any changes it deems appropriate to its Game without prior notice, and may change, delete or add both the Content and services it provides and the way in which they are presented or located.
In this regard, access to the Game and/or the Content and services offered through it shall, in principle, be indefinite, unless otherwise provided in the specific conditions applicable or in the legislation applicable at any given time. However, the User accepts that LALIGA may unilaterally terminate, suspend or interrupt, at any time and without prior notice, the availability of the Game and/or any of the services, without the User being entitled to claim any compensation, all within the limits applicable under the applicable consumer regulations. Following such termination, the User must destroy any material obtained in relation to the Game and/or the portal on which the Content is offered, including all software and related documentation, as well as any copies, printouts and installations.
If your services are cancelled or terminated, LALIGA may permanently delete the information associated with your account, including your Content, from our servers, and LALIGA shall have no obligation to return any Content to you.
11.- MODIFICATIONS TO THE TERMS OF USE.
LALIGA may, at any time, for technical reasons or due to changes in the provision of the service or in regulations, as well as modifications that may arise from applicable codes or, where applicable, due to strategic corporate decisions, replace the Terms and Conditions and the Privacy and Personal Data Protection Policy and which, depending on the case, will replace, supplement and/or modify the Terms and Conditions and Privacy and Personal Data Protection Policy.
When LALIGA replaces or modifies the Terms and Conditions or the Privacy and Personal Data Protection Policy, it will publish them on the website and/or notify Users thereof through the website, and if Users continue to use the service, LALIGA will understand that they have accepted the modifications made. In the event that the User does not agree with the modifications made, they may unsubscribe from the Game by following the usual procedure provided for this purpose.
LALIGA recommends that the user periodically consult the Terms and Conditions and Privacy and Personal Data Protection Policy, as they may be modified. The current version can be consulted at any time in the Game Terms of Use and Privacy Policy sections. The temporary validity of these legal conditions therefore coincides with the time they are displayed, until such time as they are modified in whole or in part.
12.- INTERNATIONAL TERMS OF USE.
The Game governed by these Terms and Conditions is managed by LALIGA, which operates in Spain, making its Content available within the territory of Spain. Although the Game may be accessible from outside Spain, given the "non-territorial" nature inherent in Internet access, the user understands and agrees that the Game is intended to be used mainly by Spanish users and, where applicable, by any person or entity in any country or jurisdiction where its use is not contrary to the local laws or regulations in force at any given time. Therefore, if any or all of the Content or elements hosted on the LALIGA Game are considered illegal in other countries, access to and use of them by the User is prohibited and, if this occurs, it will be exclusively under the responsibility of the User, who is obliged to comply with and observe the laws applicable in these countries.
The User's use of the Game within a specific country shall be at their own risk. Certain content and features may not be available in all countries or territories. Likewise, LALIGA informs the User that some of the Game's features may not be available and/or may not function properly in all countries due to technical and/or legal limitations.
13.- LEGISLATION AND JURISDICTIONAL COMPETENCE.
The relationship between LALIGA and the User shall be governed by the provisions of current regulations regarding applicable legislation and competent jurisdiction. However, in cases where applicable regulations so permit, these Terms of Use shall be governed by Spanish law. Furthermore, in the event that the applicable regulations provide for the possibility of the parties submitting to a jurisdiction, LALIGA and the User, expressly waiving any other jurisdiction that may apply, shall submit any disputes and/or litigation to the Courts and Tribunals of the city of Madrid.
Nothing in these Terms of Use shall exclude, limit or restrict the rights of the participant under the applicable mandatory consumer regulations.
14.- PREVAILING LANGUAGE:
The Terms and Conditions may also be available to the User in English and Arabic. The User acknowledges and accepts that, in the event of any discrepancy between the Spanish, English or Arabic versions, the Spanish version shall prevail.
