The Report of the CNMC clears the way for the launch of the competition to market the next three seasons.

Official Statement

MIÉ 08.07.2015

LaLiga received the required report and non-binding CNMC in relation to its model of centralised marketing of broadcast rights with LaLiga clubs in the next three seasons (2015/2016 a 2017/2018).

On 3rd June, La Liga solicited a report to the National Commission of Markets and Competition (CNMC) in accordance with the provisions of Royal Decree Law 5/2015 from 30th April, on urgent measures in relation to the marketing of rights to exploit audio-visual content of professional football competitions.

Since then, La Liga has worked closely with the CNMC to improve its model of centralized marketing, including the suggestions made by the CNMC services, even though its recommendations are non-binding.

On July 3rd, the CNMC notified La Liga of its report, in which a series of recommendations, praised by La Liga have been constructed:

- In relation to the central marketing bases in Spain, the recommendations of the CNMC have already been included in the latest draft statement to CNMC services, as explained above or will be included in the definitive bases.

- With regard to international marketing, LaLiga, at all times, ensure absolute control over the activities of its agent, as it has done since its appointment, and a transparent, competitive and non-discriminatory process, despite the competitive impact of their rights is marginal in foreign markets, where it competes with other football leagues and other sports.

- In relation to the recommendation to separate the 2015/2016 season from other seasons for no benefit to the two operators of audio-visual rights holders of various clubs in this season (TELEFONICA and MEDIAPRO), LaLiga notes that (1) has extensively argued, in writing and meetings with the CNMC, the urgent need to include the 2015/2016 season on a three-year cycle for the benefit of the clubs, operators and fans, according to the letter and spirit of the RDL 5/2015; (2) has signed an agreement with MEDIAPRO by which this operator gives the broadcasting rights of the 34 clubs, so it does not own any audio-visual law at this time, neither its agency contract with LaLiga marketing of media rights in the international market provides no competitive advantage in the competition for marketing in Spain. In any case, LaLiga will include provisions on the basis of marketing in Spain to guarantee full equality of opportunity for all bidders, thus solving the concern expressed by the CNMC.

Today, LaLiga will proceed with the publication of its petition on the bases to present the offers for the acquisition of the central commercialised audio-visual rights in Spain and continue collaborating with the CNMC during all of the procedure to ensure the success of a project, destined to offer a revolutionary product, benefitting the clubs, broadcasters and football fans.
