LaLiga confirms the legality of LaLiga Impulso and asks that professional football vote freely and without coercion

All of the Clubs will be able to express themselves freely regarding the agreement with CVC at the EGM which will be held on Thursday 12 August.

In response to Real Madrid’s recent announcement that it is to take legal action against members of LaLiga and CVC Capital Partners management, LaLiga would like to issue the following statement:

  1. LaLiga reiterates that it has all the favourable legal reports that confirm maximum compliance with the legal system across all dimensions and considerations regarding the LaLiga Impulso project, that has received the counsel of Uría Menéndez in the case of LaLiga and Latham & Watkins in the case of CVC.
  2. Through these actions, the management at Real Madrid CF merely intend to prevent the Clubs / SAD of professional football from ruling on the agreement with CVC Capital Partners through coercive and threatening methods.
  3. Spanish professional football will express itself freely (including Real Madrid CF) next Thursday, August 12 at the LaLiga Extraordinary General Meeting.

This decision by Real Madrid CF was a foreseeable reaction, given the Club's history of head-on opposition and appeal against any strategic initiative that represents an advance and a boost for the competition and its Clubs.

Specifically, LaLiga can count 51 legal actions brought about by Real Madrid, the majority of which have been won by LaLiga. Among the litigation won by LaLiga against Real Madrid in recent years, some of which have become critical and necessary milestones for the progress of LaLiga and its Clubs, are:

  • 2015: Approval of Royal Decree Law 5/2015, in which LaLiga managed to renegotiate the conditions for the exploitation of audiovisual rights for the 2015/2016 season so that the clubs could finally obtain a capital gain on the income derived from the contracts signed with the broadcasters. Real Madrid challenged the statutory modification that enabled the distribution of almost 300 million euros and requested a precautionary measure to prevent the distribution of such amounts among LaLiga clubs. Finally, the Courts did not consider that such a reform violated the rights of the clubs and instead represented an additional benefit, and issued a reprimand to Real Madrid for its bad faith, in detriment to the other clubs.
  • 2018/2019 season. Real Madrid challenged the annual accounts for the 2018/2019 season, considering that LaLiga lacked the capacity to deduct a series of expenses from audiovisual income and requesting the additional payment of € 23,892,977 to those received in accordance with the settlement procedure approved by the clubs. However, the Courts dismissed this claim as it considered the expenses and investments made by LaLiga to be appropriate for enhancing the value of the audiovisual rights in question.

In all these cases, the courts have agreed with LaLiga and at no time have LaLiga's governing bodies stopped and/or changed their plans for the future and growth.

LaLiga Impulso, which was unanimously approved by the League's Delegate Commission, represents an ambitious investment plan of 2.7 billion euros that will provide LaLiga and the Clubs with the resources to continue their transformation into a global digital entertainment company, strengthening the competition and transforming the fan experience.

LaLiga respects, as always, all opinions and will continue in its determination to strengthen the diversity of Spanish football and the plurality of its clubs. The enhancement that this strategic operation implies for LaLiga will benefit Spanish football as a whole, including Real Madrid, as one of the leading representatives of football around the world.
